Terms of Service
Welcome to DigitOrder.
These Terms of Service ("Terms") govern your access to and use of the DigitOrder website, platform, and related services (collectively, the "Services").
DigitOrder ("DigitOrder", "we", "our", or "us") is operated by the DigitOrder team from Egypt.
By creating an account, subscribing to a plan, or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use the Services.
These Terms should be read together with our Privacy Policy, which explains how we collect, use, and protect personal information.
1. Eligibility and Accounts
To use DigitOrder, you must:
- Be at least 18 years of age or the legal age required in your jurisdiction.
- Have the legal authority to act on behalf of yourself or the business you represent.
- Provide accurate and complete registration information.
- Keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must notify DigitOrder immediately if you believe your account has been accessed without authorization.
DigitOrder may refuse registration or suspend accounts that provide false information or violate these Terms.
2. Subscription Plans and Billing
DigitOrder provides subscription-based software for restaurants and food businesses.
Subscription plans, features, and pricing are published on our website and may be updated from time to time.
Subscriptions may be offered on:
- Monthly billing
- Annual billing
Annual plans may be offered at a discounted price compared to monthly billing.
Subscription Renewal
Subscription fees are payable in advance using the payment methods supported by DigitOrder.
Depending on the payment method selected:
- Some subscriptions renew automatically until cancelled.
- Other subscriptions require manual renewal before the subscription period expires.
Subscribers are responsible for maintaining valid payment information and renewing their subscription when required.
If a subscription cannot be renewed because payment fails or expires, DigitOrder may notify the Subscriber and provide a reasonable opportunity to update payment information before suspending access to the Services.
Cancellation
Subscribers may cancel their subscription at any time.
Cancellation prevents future renewals but does not automatically entitle the Subscriber to a refund for fees already paid, unless required by applicable law.
Unless otherwise stated, access to the Services continues until the end of the current billing period.
Payment Processing
DigitOrder may integrate with third-party payment providers to enable restaurants to accept online payments from their customers.
DigitOrder is not a bank, financial institution, payment processor, or money transmission service.
Customer payments are processed directly by the restaurant's selected payment provider under that provider's own terms and policies.
DigitOrder does not receive, hold, store, or control customer payment funds unless explicitly stated for a specific service.
DigitOrder is not responsible for payment processing errors, payment gateway outages, chargebacks, or disputes arising between a restaurant and its payment provider or customers.
Restaurants are solely responsible for their relationship with their chosen payment provider, including account verification, fees, chargebacks, refunds, and compliance with applicable financial regulations.
DigitOrder may add, remove, or change supported payment providers at any time as part of maintaining or improving the Services.
Fees and Refunds
Subscription fees are generally non-refundable except where required by applicable law or where DigitOrder expressly agrees otherwise.
Any taxes, banking fees, currency conversion fees, or payment processing charges imposed by third parties remain the responsibility of the Subscriber.
3. Merchant Responsibilities
DigitOrder provides software tools to help restaurants manage digital menus and online ordering.
The Subscriber is responsible for:
- Maintaining accurate menu information.
- Maintaining accurate pricing.
- Updating product availability.
- Managing business hours.
- Complying with applicable food safety laws.
- Complying with tax obligations.
- Fulfilling customer orders.
- Responding to customer inquiries.
DigitOrder does not prepare food, accept orders on behalf of restaurants, deliver products, or manage restaurant operations.
The Subscriber remains solely responsible for all commercial activities conducted through their business.
4. Acceptable Use
Subscribers agree to use the Services responsibly and in accordance with applicable laws.
You may not:
- Use the Services for unlawful purposes.
- Upload malicious software or harmful code.
- Attempt to gain unauthorized access to the platform.
- Interfere with the operation or security of the Services.
- Reverse engineer, copy, modify, or create derivative works of the platform except where permitted by law.
- Resell, sublicense, or redistribute the Services without written authorization.
- Use the Services to transmit spam or fraudulent content.
- Infringe the intellectual property or privacy rights of others.
DigitOrder reserves the right to investigate suspected misuse and take appropriate action, including suspension or termination of accounts.
5. Intellectual Property
DigitOrder and its licensors retain all rights, title, and interest in the Services, including:
- Software
- Source code
- User interface designs
- Logos
- Trademarks
- Documentation
- Graphics
- Databases
- Platform architecture
- Website content
These Terms do not transfer ownership of any intellectual property to the Subscriber.
Subscribers receive a limited, non-exclusive, non-transferable, revocable license to access and use the Services during an active subscription in accordance with these Terms.
Nothing in these Terms permits the Subscriber to copy, reproduce, distribute, or commercially exploit any part of the Services without prior written permission.
6. Customer Data and Ownership
Subscribers retain ownership of the content they upload to the Services, including:
- Menus
- Product information
- Images
- Restaurant branding
- Orders
- Customer information
- Business data
DigitOrder does not claim ownership of Subscriber content.
The Subscriber grants DigitOrder the limited rights necessary to host, process, display, back up, and transmit such information solely for the purpose of providing the Services.
Where restaurants collect customer information through DigitOrder, the restaurant is generally responsible for determining how that information is collected and used.
DigitOrder processes such information only as necessary to provide the Services and in accordance with the Privacy Policy.
Subscribers are responsible for ensuring they have the legal right to collect and process customer information.
Data Processing
To the extent DigitOrder processes personal information on behalf of a Subscriber, DigitOrder acts as a Data Processor where applicable under relevant data protection laws.
DigitOrder processes such information only as necessary to provide the Services, implements reasonable security measures, and assists Subscribers with applicable privacy requests as described in our Privacy Policy.
7. Third-Party Services
The Services may integrate with or rely upon third-party providers, including payment processors, messaging services, analytics providers, cloud hosting providers, or other business tools.
These third-party services operate under their own terms and privacy policies.
DigitOrder is not responsible for the availability, functionality, or practices of third-party services.
Subscribers use such integrations at their own discretion and remain responsible for complying with any applicable third-party terms.
8. Service Availability and Maintenance
DigitOrder continually improves and maintains the Services.
From time to time, the Services may become temporarily unavailable due to:
- Scheduled maintenance.
- Security updates.
- Software upgrades.
- Infrastructure changes.
- Events beyond our reasonable control.
While DigitOrder works to provide a reliable platform, uninterrupted availability cannot be guaranteed.
DigitOrder may modify, improve, replace, or discontinue features when reasonably necessary to maintain or improve the Services.
9. Suspension and Termination
Subscribers may cancel their subscription at any time through the available account management tools or by contacting DigitOrder.
Cancellation prevents future renewals but does not automatically entitle the Subscriber to a refund for any fees already paid, unless required by applicable law.
DigitOrder may suspend or terminate access to the Services if the Subscriber:
- Violates these Terms.
- Uses the Services for unlawful or fraudulent purposes.
- Fails to pay applicable subscription fees.
- Attempts to compromise the security or stability of the Services.
- Engages in conduct that may harm DigitOrder, other Subscribers, or third parties.
Where reasonably possible, DigitOrder may provide notice and an opportunity to resolve the issue before permanent termination.
Following termination, Subscribers may request an export of their business data for a reasonable period after termination, subject to technical limitations and applicable law.
Following termination, DigitOrder may retain certain information where required by law, to resolve disputes, enforce these Terms, or protect legitimate business interests. Remaining data will be handled in accordance with the Privacy Policy.
10. Disclaimers
The Services are provided on an "as is" and "as available" basis.
To the maximum extent permitted by applicable law, DigitOrder makes no warranties, express or implied, regarding the Services, including warranties of:
- Merchantability.
- Fitness for a particular purpose.
- Non-infringement.
- Continuous availability.
- Error-free operation.
DigitOrder does not guarantee that:
- The Services will always be available without interruption.
- The Services will be free from errors or security vulnerabilities.
- The Services will meet every business requirement of every Subscriber.
- Any particular business results, revenue increases, customer growth, or operational improvements will be achieved through use of the Services.
Subscribers are responsible for evaluating whether the Services are suitable for their business needs.
DigitOrder is not responsible for interruptions caused by internet connectivity, third-party services, Subscriber devices, operating systems, or other factors outside our reasonable control.
11. Limitation of Liability
To the fullest extent permitted by applicable law, DigitOrder and its owners, employees, partners, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the Services.
This includes, without limitation:
- Loss of profits.
- Loss of revenue.
- Loss of business opportunities.
- Loss of customers.
- Business interruption.
- Loss or corruption of data.
- Reputational damage.
DigitOrder's total aggregate liability arising out of or relating to these Terms or the Services shall not exceed the total subscription fees paid by the Subscriber to DigitOrder during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law, including liability for fraud, willful misconduct, or gross negligence.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law principles.
The parties will first attempt to resolve any dispute through good-faith discussions.
If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of Egypt, unless applicable law requires otherwise.
13. Changes to These Terms
DigitOrder may update these Terms from time to time to reflect:
- Changes in the Services.
- Changes in applicable laws or regulations.
- Security requirements.
- Operational improvements.
- Business developments.
When material changes are made, we will update the Last Updated date and, where required by applicable law, provide appropriate notice before the updated Terms become effective.
Continued use of the Services after the effective date of updated Terms constitutes acceptance of those changes.

Entire Agreement
These Terms of Service, together with the Privacy Policy and any additional policies or agreements expressly incorporated by reference, constitute the entire agreement between the Subscriber and DigitOrder regarding the use of the Services and supersede any prior agreements or understandings relating to the same subject matter.
If any provision of these Terms is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
