Terms and Conditions

This agreement covers all subscribers to DigitOrder services and its website, which are owned and operated by DigitOrder. Using the Service means agreeing to the terms of this Agreement in addition to any future amendments to this Agreement that will be published from time to time.
1. Please read the following terms carefully before subscribing to DigitOrder services ("Services"), as they represent a valid, binding contract between DigitOrder and the users of the services ("Subscriber"), with obligations binding on all parties.
2. All services provided by DigitOrder to the subscriber and the features and tools they contain are subject to these terms, including any additions or upgrades to the current services. Subscribing to the services requires agreement to these terms and any updates therein, and compliance with all applicable laws and regulations.
3. DigitOrder reserves the right to make changes or amendments to these terms. Please check them regularly for any updates, as any new terms will automatically take effect once they are published on the website.
(2) Definitions
The following terms have the meanings indicated next to each unless the context requires otherwise:
1. "Site": refers to the DigitOrder website on the .com domain and the information, visual and audio files it contains.
2. "Service Provider": refers to DigitOrder.
3. "Subscriber": refers to everyone who subscribes to the Services, whether an individual or an entity (commercial, government, or non-profit).
4. "Fees": refers to the value of subscribing to services according to the packages prescribed by the service provider for using the services during the subscription period.
5. "Services": refers to DigitOrder’s services and the features, tools, and features they include through the site.
6. "Terms and Conditions", "Agreement": refers to these terms and the privacy policy and the terms it contains that are binding on the subscriber.
(3) Digital Signature
By subscribing to the Services, or clicking to accept the Terms and Conditions when prompted to do so, you are deemed to have executed these Terms and Conditions electronically, and they will be legally effective against you from the date of paying the subscription fees or from the date of clicking to accept the Terms and Conditions.
(4) Duration of Subscription
1. Your subscription begins from the date of payment of the subscription amount according to the subscription plan.
2. The subscription is automatically renewed with the same features available in the subscription plan once the fees are collected from the credit cards or payment method approved by the service provider. Subscribers will receive a reminder email about the upcoming renewal at least 7 days before the renewal date.
3. The terms of this agreement apply from the date you subscribe to the services and pay the prescribed fees for the subscription plan. The service provider has the right to cancel the subscription and delete the services data if you do not comply with the terms of this agreement.
(5) Subscription and Payment Plans
1. DigitOrder offers a free 15-day trial plan for new subscribers, allowing access to a limited set of features during this trial period. before the trial period ends, they will need to choose either a yearly or monthly subscription plan to continue using the Services.
2. During the trial period, subscribers have access to basic features and functionalities of the Services. Additional features available in paid subscription plans will not be accessible during the trial period.
3. At the end of the trial period, if the subscriber does not select a subscription plan, their account will be deactivated. The subscriber must then choose a yearly or monthly subscription plan and complete the payment process to reactivate their account and continue using the Services.
4. DigitOrder services are provided under monthly and annual subscription plans.
5. The subscriber agrees to pay all amounts due according to the subscription plan in advance to the service provider and bear all payment processing fees.
6. The service provider provides payment through credit cards, bank transfer, or offline transfer to the DigitOrder account.
7- The subscriber must ensure that the payment information, whether for credit cards, bank transfer, or offline transfer, is correct before completing the payment process.
8- The subscriber must use their own bank cards, and if they use a card belonging to another person, they must have authorization or permission to use it. Therefore, DigitOrder does not bear responsibility towards any party as a result of the use of these cards.
9- DigitOrder does not bear responsibility for the subscriber’s error in the payment process, nor does it bear responsibility as a result of hacking or fraudulent operations on the cards used for payment.
10- DigitOrder reserves the right to modify or change Subscription Plans at any time it deems appropriate in its sole discretion. If applicable, it will not affect the existing Subscription Plan and will only be applicable to new subscribers or new subscriptions.
11- DigitOrder reserves the right to modify or terminate the free trial offer at any time without prior notice. Any changes to the trial offer will be communicated to subscribers via email or through the DigitOrder website.
(6) Use Licenses
• The Service Provider grants you a limited, non-exclusive, non-transferable license upon payment of the subscription plan fees to:
- Access the Service and use the Services with all its features and benefits in accordance with the Subscription Plan for your personal use only, and in accordance with these Terms.
- Access any content, information or related materials on the Site for personal use.
• The rights granted to you in these Terms are subject to the following restrictions. You may not:
- Use the Service outside of the purposes expressly permitted by these Terms.
- License, sell, rent, transfer, assign, distribute, host or exploit the Service.
- Modify, adapt, merge or make derivative works of the Service.
- Access the Service or Site in order to create similar or competing services.
- Post, transmit or introduce any material that contains viruses or any other harmful software, malicious code, files or any other computer software or programs designed to damage or interfere with the normal operation of the Service (or any part thereof).
- Posting unwanted electronic messages (spam) or supporting any illegal activities.
- Tampering with data and information and attempting to modify or destroy any security or documentation procedures.
- Attempt to gain unauthorized access to the Service or Site or the servers or systems connected to the Service or Site.
- Remove, destroy or alter any trademarks, copyrights or proprietary markings contained in the Service or the Site.
• The subscriber acknowledges and agrees that failure to comply with any of the previous restrictions will result in immediate termination of the subscription, and without refund of the amounts paid.
(7) Support and Maintenance
• The service provider provides the maximum electronic protection methods for services, and for the purposes of the development process periodically, it is necessary to inform the service provider of all data entered by the subscriber.
• The subscriber's data is his own property and he has all rights and powers over it. It will not be dealt with by the service provider except in cases of maintenance and security tests, and this data will be kept safe and confidential.
• The subscriber may submit a request to the service provider to transfer, delete, copy or modify his data at any time, and this request will be dealt with by our work team with everything necessary and necessary in this regard.
• DigitOrder (the Service Provider) is solely responsible for providing any support and maintenance services for the Services as specified in these Terms.
• Subscriber agrees that no other party is responsible for providing support and maintenance services for the Services.
• The service provider will provide technical support to the subscriber during the subscription plan, and the support includes:
- Updates or improvements to the Services without additional costs.
- Electronic means to help the subscriber understand the problem and help him solve it.
• The service provider provides the subscriber with the necessary maintenance work to upgrade the services, add new features, provide backup, provide the necessary protection, or fill security gaps, if any. The service may stop for the period of scheduled maintenance work. If this period exceeds seven days, the subscriber will be compensated with an amount equivalent to Days of service interruption.
• Support is available all week except Saturday and Sunday.
(8) Customize Service
• If the subscriber wishes to add new features and features that are not available in the services, he must submit a request to the service provider for the request to be studied.
• The service provider has the right to reject the request if the subscriber’s request fundamentally conflicts with the other features and characteristics of the services.
• If the request is accepted by the service provider and can be implemented, the customization fees will be calculated based on the volume of work and the duration of its implementation in accordance with the service provider’s agenda.
• A quote is provided with the required customization fees and added to the subscription plan regardless of the remaining duration of the subscription.
• If there are any discounts or offers on subscription plans, the customization fee does not include any discounts or offers provided by the service provider.
• When a Subscriber requests customization of features and features of the Services, the data of the current version is copied according to the Subscription Plan on a separate server at an additional cost.
• The subscriber does not get the additional free features offered over the version available from the service provider if a separate version is allocated to the subscriber, such as periodic updates and developments.
(9) Cancel or Terminate the Subscription
• The service provider has the right to terminate the subscription in the following cases:
- Subscriber’s misuse of the service or the information contained therein or use for purposes other than its intended purpose.
- Violation of one of the subscription conditions.
- Requesting the competent authorities to stop or suspend the service completely or partially for the subscriber.
- Failure to pay the amounts due for the subscription plan on time.
- Abusing the service provider, whether in correspondence, telephone calls, or the technical support system.
• The subscriber has the right to terminate the subscription by not paying the subscription plan fees or by writing to the service provider’s technical support requesting that they stop the service and cancel the subscription.
• The subscription amount will not be refunded in the event of cancellation, but you may continue to use the Service until the end of the applicable subscription period.
• This agreement shall be automatically terminated in cases of termination or cancellation of the subscription. The service provider has the right to delete the subscriber’s data after termination, and may, at its discretion, give the subscriber a period of time to copy his data.
(10) Disclaimer
• DigitOrder services with all the features and features it provides, and the services, content and information contained on the website .com are provided on a consistent “as is” and “as available” basis without any warranties or representations of any kind, whether express or implied, regarding the accuracy or completeness of the information contained. On this website, all such information is indicative in nature and may be changed at any time without prior notice.
• The Service Provider will not be liable for direct, indirect, consequential or incidental losses or damages in connection with any use of the Services including but not limited to:
- Any information, materials or recommendations relating to the Services.
- Use the Services with any incompatible operating system.
- Loss or non-recovery of any subscriber data.
- Damages resulting from any means of communication for using the site or service.
• The service provider will not bear responsibility for damages incurred by the subscriber as a result of misuse or lack of understanding of the mechanism of operation of the services or failure to recognize the features and advantages of the services.
• The subscriber is obligated to use the service for his legitimate purposes only. He is not allowed to grant a license to use the services to other people, whether privately or for commercial reasons.
(11) Intellectual Property Rights
• DigitOrder reserves all intellectual property rights in the Services and all trademarks, service marks, trade names, trade dress and content provided on the Site, and other intellectual property rights in the Services and the Site including without limitation: text, graphics, images, multimedia clips, logos and icons, buttons, digital materials, documentation, data compilations, software, programming rights, other code, and the selection and arrangement of the contents of the Site are protected by intellectual property rights and laws, copyright and trademark laws.
• You are not permitted to publish, distribute, reproduce or copy any part of the Services provided to you or made available on the Site, or use any part of the Site Content for commercial purposes without obtaining a license from us to do so.
• Nothing contained in the Terms shall be construed as transferring any rights or ownership in the Services or Service Content, or granting Subscriber any license or right to use the Services or the DigitOrder trademark or any trademark in the Services for commercial purposes without the prior written permission of the Service Provider.
(12) Force Majeure
The service provider will not bear any responsibility for failure or delay in performance if this results from circumstances beyond control, force majeure, or emergency circumstances that lead to the suspension or disruption of the normal and automatic operation of the services.
(13) Communications and Notices
• We may communicate with you by email to provide you with services, products, or any new features or features in the Services, or send you notices regarding future updates or changes to these Terms, or technical notices, updates, security alerts, support messages, and other administrative messages. You agree that all notices and other communications that we provide to you electronically satisfy any legal requirement as if such communications were in writing.

• You may opt out of receiving any such communications or notifications by writing to us at support@digitorder.com, but in this case we cannot guarantee that you will fully enjoy our services.
(14) Compensation
You agree to indemnify DigitOrder and any of its affiliates, directors, employees or licensors from any and all claims, liabilities, damages, losses or expenses, including legal fees and attorneys' fees, arising from:
• Any claim resulting from your use of the Services.
• Misuse or any illegal use of the Services of any kind.
• Your failure to comply with these terms.
• Violation of intellectual property rights or trademarks.
(15) Amendments
• DigitOrder reserves the right, in its sole discretion, to update, modify or otherwise change these Terms at any time, and the "Effective Date" will be updated at the top of this page.
• All modifications will be effective immediately upon posting to the Services or Site, and will apply to all of your use of the Services thereafter.
• Your continued use of DigitOrder services after amendments or changes to these terms are made constitutes the subscriber’s express consent to them and legal acceptance of the latest version of these terms, and the subscriber agrees that the newer version has replaced the previous versions.
• DigitOrder reserves the right to modify or upgrade certain features of the Services.
(16) Term and Termination of Terms
• These Terms go into effect once you sign up for and agree to the Service, and remain in full force and effect while you use the Services unless terminated by us or you as provided in these Terms.
• If you violate one of these Terms, your subscription, license to access the Service, and these Terms will automatically terminate.
• These conditions may only be canceled by a decision issued by DigitOrder.
(17) Separability
If any provision of these Terms is held to be invalid or unenforceable under applicable laws, then that provision will be severed from these Terms and will not affect the validity and enforceability of the remaining provisions, with the remaining provisions being enforceable.
(18) Waiver
• Any services provided by the service provider under these terms are personal services to the subscriber and he has no right to transfer or assign them to any other party.
• DigitOrder may assign, transfer or subcontract its rights and obligations to any third party without any objection from the Subscriber provided that such third party agrees to be bound by these Terms.
• We have the right to assign these Terms to any other party, and any failure on our part to enforce any part of these Terms does not constitute a waiver of any of our rights under these Terms whether in the context of past or future actions on the part of any subscriber.
(19) Relationship
Subscriber agrees that nothing in these Terms shall be construed as creating a joint venture, partnership, employment or agency relationship between him and DigitOrder as a result of his use of the Services or the Site.
(20) Language
These conditions were drafted in English, and if they are translated into another language, the English version is the one approved before all parties in the event of a conflict with any version in another language.
(21) Conflict
In the event that these terms conflict with any previous version, the current version shall prevail.
(22) Complete Agreement
These Terms constitute the complete and final agreement between DigitOrder and the Subscriber, and supersede any agreements, whether oral or written, or any prior versions of these Terms. Any verbal or written statements not included in these terms are not binding.
